[community profile] scans_daily suspended

For all members of [livejournal.com profile] scans_daily: the community has been suspended for posting copyrighted material without the permission of copyright holders, which is against LiveJournal's ToS. Before you ask:

1) At this time we don't know who made the complaint. But guys, we don't want this to turn into a witch hunt.

2) No, we don't have backups, but we're looking into recovering our entries. ETA: [livejournal.com profile] pandanoai made a backup early this month. You'll need this to view it. [livejournal.com profile] acroamatica has it mirrored here.

3) [livejournal.com profile] rabican set up a backup comm on insanejournal some time ago. If you're in dire need of scans, go here for now. ETA: A while ago, [livejournal.com profile] sir_razorback set up a message board for the comm here. [livejournal.com profile] comics_scans is another scan comm on eljay. Their rules and culture are a bit different from ours. If you join, be sure to read the userinfo before posting. [livejournal.com profile] stubbleupdate has set up [livejournal.com profile] noscans_daily. Please join, so we can keep our community together.

4) No, this will not be the end of us. Vive les scans!

5) ETA: Since people are asking about eljay's stance on fair use, from the TOS:

LiveJournal and its designates shall have the right, but not the obligation, to remove any content that violates the TOS or is otherwise objectionable, or that infringes or is alleged to infringe intellectual property rights. You agree that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content. Furthermore, LiveJournal reserves the right to limit access to your journal, if found in violation of the TOS, including without limitation the Member Conduct described below, by removing the journal and related user information from the member directory, search engine, and all other methods used in conjunction with finding LiveJournal's users.

and

[members agree not to] Upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party

ETA: Guys, do me a favour and link to this post in your personal journals/blogs/whatever. I don't want people to get misinformation. I'm monitoring the comments and will be around to answer questions.

ETA: Update post here.

Thanks for the quick response. I need to find something to scan for the new(ish) community.

*clings to hope*

[identity profile] schmevil.livejournal.com 2009-02-28 02:11 am (UTC)(link)
Yes, scans to help us through this dark hour.

GET ME 7 HAL JORDAN BUTTSHOTS AND A HALF DOZEN BLACK CANARY BOOBS, STAT!

Thank you for this post.

This really sucks. That community did more to get me into comics than anything else. It was free advertising for the industry.

[identity profile] outlawpoet.livejournal.com 2009-02-28 02:22 am (UTC)(link)
I'm seeing this repeated all over. Lots of people got into comics, or expanded their buying because of what they saw there, myself included.

Oh wow, that really sucks.

Edit

[identity profile] kali921.livejournal.com 2009-02-28 02:25 am (UTC)(link)
Is the comm permanently suspended? Do you have any recourse? Can you give us more info? What about JournalFen, which is pretty fierce about fighting accusations of copyright violation?

Edit: there's still [livejournal.com profile] comics_scans!

[identity profile] kali921.livejournal.com 2009-02-28 02:27 am (UTC)(link)
I lost my epic Danny and Misty and DOTD post. God, so many good memories down the toilet. All that beautiful speculation about the War of Light. All the annotations and discussion about Final Crisis and Civil War. Gone. :-(

[identity profile] fleur-de-liz.livejournal.com 2009-02-28 02:27 am (UTC)(link)
Man, I knew you guys would be up on it. And I just finished sending [livejournal.com profile] rabican a PM too.

This is...I feel gutted.

[identity profile] fleur-de-liz.livejournal.com 2009-02-28 02:28 am (UTC)(link)
Almost all of the scans archived at [livejournal.com profile] boostle were from s_d.

[identity profile] redsilkscarf.livejournal.com 2009-02-28 02:28 am (UTC)(link)
Glad to hear some news about this! I saw that the community was suspended, freaked, and then freaked again because I was worried about not being able to find anything out about this. Thank you!

[identity profile] tammylee.livejournal.com 2009-02-28 02:30 am (UTC)(link)
I always saw Scans_daily as being a review sort of site!
Boooo on being suspended.

*spreads the word*

[identity profile] bienegold.livejournal.com 2009-02-28 02:32 am (UTC)(link)
Word. I just started getting into comics, and just because of s_d.

[identity profile] foxhack.livejournal.com 2009-02-28 02:33 am (UTC)(link)
IT WAS DIDIO

Or hell maybe it was Greg Land.

Seriously though, if you can get the posts back, I'd appreciate it. I'd like to repost them at my website or something. :)

Edit: Message reposted at my journal.

[identity profile] thatnickguy.livejournal.com 2009-02-28 02:34 am (UTC)(link)
I'm not one to hold a grudge or anything, so I'd be very curious to see what it was that got us nuked. I heard something about a PAD kerfuffle last week?

[identity profile] neotoma.livejournal.com 2009-02-28 02:35 am (UTC)(link)
Oy... I bought twice as many trades in the last six months than I had in the previous three years because of stuff I saw on Scans_Daily.

It could only be of benefit to the industry to have so many people pushing so many comic books -- especially the small press ones!

[identity profile] kagome654.livejournal.com 2009-02-28 02:35 am (UTC)(link)
It really does suck. Losing the scans themselves stinks, but some of those back-and-forths in the comments were things of beauty. I just noticed that the vast majority of my memories are from [livejournal.com profile] scans_daily, some going as far back as 2005. Boo and hiss.

ETA: Also, my grammar sucks

[identity profile] kijikun.livejournal.com 2009-02-28 02:36 am (UTC)(link)
What but weren't we in the grounds of fair use? Didn't lj tell us we could STAY once?

I take it there is no chance to get the commuinty back? Because ij isn't going to cut it since some people won't even go there. Fucking lj.

[identity profile] jarodrussell.livejournal.com 2009-02-28 02:36 am (UTC)(link)
Major suckage. Sorry to hear it. If you need help backing things up, check out ljbackup.pl (http://code.sixapart.com/svn/livejournal/trunk/src/jbackup/jbackup.pl). Though, I can't find whether or not is grabs communities.

Re: Edit

[identity profile] kijikun.livejournal.com 2009-02-28 02:39 am (UTC)(link)
Yeah, but comics_scans doesn't allow webcomic or fan art which was a pretty cool part of s_d

[identity profile] schmevil.livejournal.com 2009-02-28 02:40 am (UTC)(link)
SD got me back into superhero comics. For a long time I only read 'lit' comics, but the comm made superheroes fun for me again.

[identity profile] kali921.livejournal.com 2009-02-28 02:40 am (UTC)(link)
I'll be interested to see clarification from the mods as to how and if they're fighting this. Because I've seen people on LJ fight suspensions over copyright violations and actually prevail in an instance or two, and it's certainly worth a shot.

[identity profile] crantz.livejournal.com 2009-02-28 02:40 am (UTC)(link)
Did you have comment replies on? If you search your email, you might be able to find the html of the post.

[identity profile] nataku-kun.livejournal.com 2009-02-28 02:40 am (UTC)(link)
Hell... I didn't really give a toss about American comics until I started going through Scans_Daily. I'm pretty sure quite a few other people expanded their reading range too because off scans_daily. My word, this is disappointing. Thank you for the update... I found out when I was clicking the "Back" button on the browser and just thought LJ had stuffed up or something but then panicked...
